A BILL

To regulate the importation, manufacture, possession, sale or transfer of assault weapons, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “Assault Weapons Ban of 2018”.

SEC. 2. DEFINITIONS.

 

(a) In General.—Section 921(a) of title 18, United States Code, is amended—

(1) by inserting after paragraph (29) the following:

“(30) The term ‘semiautomatic pistol’ means any repeating pistol that—

“(A) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and

“(B) requires a separate pull of the trigger to fire each cartridge.

“(31) The term ‘semiautomatic shotgun’ means any repeating shotgun that—

“(A) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and

“(B) requires a separate pull of the trigger to fire each cartridge.”; and

(2) by adding at the end the following:

“(36) The term ‘semiautomatic assault weapon’ means any of the following, regardless of country of manufacture or caliber of ammunition accepted:

“(A) A semiautomatic rifle that has the capacity to accept a detachable magazine and any one of the following:

“(i) A pistol grip.

“(ii) A forward grip.

“(iii) A folding, telescoping, or detachable stock.

“(iv) A grenade launcher or rocket launcher.

“(v) A barrel shroud.

“(vi) A threaded barrel.

“(B) A semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds, except for an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.

“(C) Any part, combination of parts, component, device, attachment, or accessory that is designed or functions to accelerate the rate of fire of a semiautomatic rifle but not convert the semiautomatic rifle into a machinegun.

“(D) A semiautomatic pistol that has the capacity to accept a detachable magazine and any one of the following:

“(i) A threaded barrel.

“(ii) A second pistol grip.

“(iii) A barrel shroud.

“(iv) The capacity to accept a detachable magazine at some location outside of the pistol grip.

“(v) A semiautomatic version of an automatic firearm.

“(E) A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.

“(F) A semiautomatic shotgun that has any one of the following:

“(i) A folding, telescoping, or detachable stock.

“(ii) A pistol grip.

“(iii) A fixed magazine with the capacity to accept more than 5 rounds.

“(iv) The ability to accept a detachable magazine.

“(v) A forward grip.

“(vi) A grenade launcher or rocket launcher.

“(G) Any shotgun with a revolving cylinder.

“(H) All of the following rifles, copies, duplicates, variants, or altered facsimiles with the capability of any such weapon thereof:

“(i) All AK types, including the following:

“(I) AK, AK47, AK47S, AK–74, AKM, AKS, ARM, MAK90, MISR, NHM90, NHM91, Rock River Arms LAR–47, SA85, SA93, Vector Arms AK–47, VEPR, WASR–10, and WUM.

“(II) IZHMASH Saiga AK.

“(III) MAADI AK47 and ARM.

“(IV) Norinco 56S, 56S2, 84S, and 86S.

“(V) Poly Technologies AK47 and AKS.

“(ii) All AR types, including the following:

“(I) AR–10.

“(II) AR–15.

“(III) Alexander Arms Overmatch Plus 16.

“(L) Any combination of parts from which a firearm described in subparagraphs (A) through (K) can be assembled.

“(M) The frame or receiver of a rifle or shotgun described in subparagraph (A), (B), (C), (F), (G), (H), (J), or (K).

“(37) The term ‘large capacity ammunition feeding device’—

“(A) means a magazine, belt, drum, feed strip, or similar device, including any such device joined or coupled with another in any manner, that has an overall capacity of, or that can be readily restored, changed, or converted to accept, more than 10 rounds of ammunition; and

“(B) does not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.”.

(b) Related Definitions.—Section 921(a) of title 18, United States Code, as amended by this Act, is amended by adding at the end the following:

“(38) The term ‘barrel shroud’—

“(A) means a shroud that is attached to, or partially or completely encircles, the barrel of a firearm so that the shroud protects the user of the firearm from heat generated by the barrel; and

“(B) does not include—

“(i) a slide that partially or completely encloses the barrel; or

“(ii) an extension of the stock along the bottom of the barrel which does not encircle or substantially encircle the barrel.

“(39) The term ‘detachable magazine’ means an ammunition feeding device that can be removed from a firearm without disassembly of the firearm action.

“(40) The term ‘fixed magazine’ means an ammunition feeding device that is permanently fixed to the firearm in such a manner that it cannot be removed without disassembly of the firearm.

“(41) The term ‘folding, telescoping, or detachable stock’ means a stock that folds, telescopes, detaches or otherwise operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability, of a firearm.

“(42) The term ‘forward grip’ means a grip located forward of the trigger that functions as a pistol grip.

“(43) The term ‘rocket’ means any simple or complex tubelike device containing combustibles that on being ignited liberate gases whose action propels the tube through the air and has a propellant charge of not more than 4 ounces.

“(44) The term ‘grenade launcher or rocket launcher’ means an attachment for use on a firearm that is designed to propel a grenade, rocket, or other similar destructive device.

“(45) The term ‘permanently inoperable’ means a firearm which is incapable of discharging a shot by means of an explosive and incapable of being readily restored to a firing condition.

“(46) The term ‘pistol grip’ means a grip, a thumbhole stock, or any other characteristic that can function as a grip.

“(47) The term ‘threaded barrel’ means a feature or characteristic that is designed in such a manner to allow for the attachment of a device such as a firearm silencer or a flash suppressor.

“(48) The term ‘qualified law enforcement officer’ has the meaning given the term in section 926B.

“(49) The term ‘grandfathered semiautomatic assault weapon’ means any semiautomatic assault weapon the importation, possession, sale, or transfer of which would be unlawful under section 922(v) but for the exception under paragraph (2) of such section.

“(50) The term ‘belt-fed semiautomatic firearm’ means any repeating firearm that—

“(A) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round;

“(B) requires a separate pull of the trigger to fire each cartridge; and

“(C) has the capacity to accept a belt ammunition feeding device.”.

SEC. 3. RESTRICTIONS ON ASSAULT WEAPONS AND LARGE CAPACITY AMMUNITION FEEDING DEVICES.

 

(a) In General.—Section 922 of title 18, United States Code, is amended—

(1) by inserting after subsection (u) the following:

“(v)(1) It shall be unlawful for a person to import, sell, manufacture, transfer, or possess, in or affecting interstate or foreign commerce, a semiautomatic assault weapon.

“(2) Paragraph (1) shall not apply to the possession, sale, or transfer of any semiautomatic assault weapon otherwise lawfully possessed under Federal law on the date of enactment of the Assault Weapons Ban of 2018.

“(3) Paragraph (1) shall not apply to any firearm that—

“(A) is manually operated by bolt, pump, lever, or slide action;

“(B) has been rendered permanently inoperable; or

“(C) is an antique firearm, as defined in section 921 of this title.

“(4) Paragraph (1) shall not apply to—

“(A) the importation for, manufacture for, sale to, transfer to, or possession by the United States or a department or agency of the United States or a State or a department, agency, or political subdivision of a State, or a sale or transfer to or possession by a qualified law enforcement officer employed by the United States or a department or agency of the United States or a State or a department, agency, or political subdivision of a State, for purposes of law enforcement (whether on or off duty), or a sale or transfer to or possession by a campus law enforcement officer for purposes of law enforcement (whether on or off duty);

“(B) the importation for, or sale or transfer to a licensee under title I of the Atomic Energy Act of 1954 for purposes of establishing and maintaining an on-site physical protection system and security organization required by Federal law, or possession by an employee or contractor of such licensee on-site for such purposes or off-site for purposes of licensee-authorized training or transportation of nuclear materials;

“(C) the possession, by an individual who is retired in good standing from service with a law enforcement agency and is not otherwise prohibited from receiving a firearm, of a semiautomatic assault weapon—

“(i) sold or transferred to the individual by the agency upon such retirement; or

“(ii) that the individual purchased, or otherwise obtained, for official use before such retirement;

“(D) the importation, sale, manufacture, transfer, or possession of a semiautomatic assault weapon by a licensed manufacturer or licensed importer for the purposes of testing or experimentation authorized by the Attorney General; or

“(E) the importation, sale, manufacture, transfer, or possession of a firearm specified in Appendix A to this section, as such firearm was manufactured on the date of introduction of the Assault Weapons Ban of 2018.

“(5) For purposes of paragraph (4)(A), the term ‘campus law enforcement officer’ means an individual who is—

“(A) employed by a private institution of higher education that is eligible for funding under title IV of the Higher Education Act of 1965 (20 U.S.C. 1070 et seq.);

“(B) responsible for the prevention or investigation of crime involving injury to persons or property, including apprehension or detention of persons for such crimes;

“(C) authorized by Federal, State, or local law to carry a firearm, execute search warrants, and make arrests; and

“(D) recognized, commissioned, or certified by a government entity as a law enforcement officer.

“(6) The Attorney General shall establish and maintain, in a timely manner, a record of the make, model, and, if available, date of manufacture of any semiautomatic assault weapon which the Attorney General is made aware has been used in relation to a crime under Federal or State law, and the nature and circumstances of the crime involved, including the outcome of relevant criminal investigations and proceedings. The Attorney General shall annually submit a copy of the record established under this paragraph to the Congress and make the record available to the general public.

“(w)(1) It shall be unlawful for a person to import, sell, manufacture, transfer, or possess, in or affecting interstate or foreign commerce, a large capacity ammunition feeding device.

“(2) Paragraph (1) shall not apply to the possession of any large capacity ammunition feeding device otherwise lawfully possessed on or before the date of enactment of the Assault Weapons Ban of 2018.

“(3) Paragraph (1) shall not apply to—

“(A) the importation for, manufacture for, sale to, transfer to, or possession by the United States or a department or agency of the United States or a State or a department, agency, or political subdivision of a State, or a sale or transfer to or possession by a qualified law enforcement officer employed by the United States or a department or agency of the United States or a State or a department, agency, or political subdivision of a State for purposes of law enforcement (whether on or off duty), or a sale or transfer to or possession by a campus law enforcement officer for purposes of law enforcement (whether on or off duty);

“(B) the importation for, or sale or transfer to a licensee under title I of the Atomic Energy Act of 1954 for purposes of establishing and maintaining an on-site physical protection system and security organization required by Federal law, or possession by an employee or contractor of such licensee on-site for such purposes or off-site for purposes of licensee-authorized training or transportation of nuclear materials;

“(C) the possession, by an individual who is retired in good standing from service with a law enforcement agency and is not otherwise prohibited from receiving ammunition, of a large capacity ammunition feeding device—

“(i) sold or transferred to the individual by the agency upon such retirement; or

“(ii) that the individual purchased, or otherwise obtained, for official use before such retirement; or

“(D) the importation, sale, manufacture, transfer, or possession of any large capacity ammunition feeding device by a licensed manufacturer or licensed importer for the purposes of testing or experimentation authorized by the Attorney General.

“(4) For purposes of paragraph (3)(A), the term ‘campus law enforcement officer’ means an individual who is—

“(A) employed by a private institution of higher education that is eligible for funding under title IV of the Higher Education Act of 1965 (20 U.S.C. 1070 et seq.);

“(B) responsible for the prevention or investigation of crime involving injury to persons or property, including apprehension or detention of persons for such crimes;

“(C) authorized by Federal, State, or local law to carry a firearm, execute search warrants, and make arrests; and

“(D) recognized, commissioned, or certified by a government entity as a law enforcement officer.”; and

(2) by adding at the end the following:

“(aa) Secure Storage Or Safety Device Requirement For Grandfathered Semiautomatic Assault Weapons.—It shall be unlawful for any person, other than a licensed importer, licensed manufacturer, or licensed dealer, to store or keep under the dominion or control of that person any grandfathered semiautomatic assault weapon that the person knows, or has reasonable cause to believe, will be accessible to an individual prohibited from receiving or possessing a firearm under subsection (g), (n), or (x), or any provision of State law, unless the grandfathered semiautomatic assault weapon is—

“(1) carried on the person, or within such close proximity that the person can readily retrieve and use the grandfathered semiautomatic assault weapon as if the grandfathered semiautomatic assault weapon were carried on the person; or

“(2) locked by a secure gun storage or safety device that the prohibited individual has no ability to access.”.

(b) Identification Markings For Semiautomatic Assault Weapons.—Section 923(i) of title 18, United States Code, is amended by adding at the end the following: “The serial number of any semiautomatic assault weapon manufactured after the date of enactment of the Assault Weapons Ban of 2018 shall clearly show the date on which the weapon was manufactured or made, legibly and conspicuously engraved or cast on the weapon, and such other identification as the Attorney General shall by regulations prescribe.”.

(c) Identification Markings For Large Capacity Ammunition Feeding Devices.—Section 923(i) of title 18, United States Code, as amended by this Act, is amended by adding at the end the following: “A large capacity ammunition feeding device manufactured after the date of enactment of the Assault Weapons Ban of 2018 shall be identified by a serial number and the date on which the device was manufactured or made, legibly and conspicuously engraved or cast on the device, and such other identification as the Attorney General shall by regulations prescribe.”.

(d) Seizure And Forfeiture Of Large Capacity Ammunition Feeding Devices.—Subsection (d) of section 924 of title 18, United States Code, is amended—

(1) in paragraph (1)—

(A) by inserting “or large capacity ammunition feeding device” after “firearm or ammunition” each time it appears;

(B) by inserting “or large capacity ammunition feeding device” after “firearms or ammunition” each time it appears; and

(C) by striking “or (k)” and inserting “(k), (r), (v), or (w)”;

(2) in paragraph (2)—

(A) in subparagraph (C), by inserting “or large capacity ammunition feeding devices” after “firearms or quantities of ammunition”; and

(3) in paragraph (3)—

(A) in subparagraph (E), by inserting “922(r), 922(v), 922(w),” after “922(n),”.

(e) Appendix A.—Section 922 of title 18, United States Code, is amended by adding at the end the following:

SEC. 4. PENALTIES.

Section 924(a)(1)(B) of title 18, United States Code, is amended by striking “or (q) of section 922” and inserting “(q), (r), (v), (w), or (aa) of section 922”.

SEC. 5. BACKGROUND CHECKS FOR TRANSFERS OF GRANDFATHERED SEMIAUTOMATIC ASSAULT WEAPONS.

 

(a) In General.—Section 922 of title 18, United States Code, as amended by this Act, is amended—

(1) by repealing subsection (s);

(2) by redesignating subsection (t) as subsection (s);

(3) in subsection (s), as redesignated—

(A) in paragraph (3)(C)(ii), by striking “(as defined in subsection (s)(8))”; and

(B) by adding at the end the following:

“(7) In this subsection, the term ‘chief law enforcement officer’ means the chief of police, the sheriff, or an equivalent officer or the designee of any such individual.”; and

(4) by inserting after subsection (s), as redesignated, the following:

“(t)(1) Beginning on the date that is 90 days after the date of enactment of the Assault Weapons Ban of 2018, it shall be unlawful for any person who is not licensed under this chapter to transfer a grandfathered semiautomatic assault weapon to any other person who is not licensed under this chapter, unless a licensed importer, licensed manufacturer, or licensed dealer has first taken custody of the grandfathered semiautomatic assault weapon for the purpose of complying with subsection (s). Upon taking custody of the grandfathered semiautomatic assault weapon, the licensee shall comply with all requirements of this chapter as if the licensee were transferring the grandfathered semiautomatic assault weapon from the licensee’s inventory to the unlicensed transferee.

“(2) Paragraph (1) shall not apply to a temporary transfer of possession for the purpose of participating in target shooting in a licensed target facility or established range if—

“(A) the grandfathered semiautomatic assault weapon is, at all times, kept within the premises of the target facility or range; and

“(B) the transferee is not known to be prohibited from possessing or receiving a grandfathered semiautomatic assault weapon.

“(3) For purposes of this subsection, the term ‘transfer’—

“(A) shall include a sale, gift, or loan; and

“(B) does not include temporary custody of the grandfathered semiautomatic assault weapon for purposes of examination or evaluation by a prospective transferee.

“(4)(A) Notwithstanding any other provision of this chapter, the Attorney General may implement this subsection with regulations.

“(B) Regulations promulgated under this paragraph—

“(i) shall include a provision setting a maximum fee that may be charged by licensees for services provided in accordance with paragraph (1); and

“(ii) shall not include any provision imposing recordkeeping requirements on any unlicensed transferor or requiring licensees to facilitate transfers in accordance with paragraph (1).”.

(b) Technical And Conforming Amendments.—

(1) SECTION 922.—Section 922(y)(2) of title 18, United States Code, is amended, in the matter preceding subparagraph (A), by striking “, (g)(5)(B), and (s)(3)(B)(v)(II)” and inserting “and (g)(5)(B)”.

(2) SECTION 925A.—Section 925A of title 18, United States Code, is amended, in the matter preceding paragraph (1), by striking “subsection (s) or (t) of section 922” and inserting “section 922(s)”.

(c) Effective Date.—The amendments made by this section shall take effect 90 days after the date of enactment of this Act.

SEC. 6. NOTIFICATION TO LAW ENFORCEMENT AGENCIES OF PROHIBITED PURCHASE OR ATTEMPTED PURCHASE OF A FIREARM.

 

(a) In General.—Title I of the NICS Improvement Amendments Act of 2007 (34 U.S.C. 40911–40916) is amended by adding at the end the following:

“SEC. 107. NOTIFICATION TO LAW ENFORCEMENT AGENCIES OF PROHIBITED PURCHASE OR ATTEMPTED PURCHASE OF A GRANDFATHERED SEMIAUTOMATIC ASSAULT WEAPON.

 

“(a) In General.—In the case of a background check conducted by the National Instant Criminal Background Check System pursuant to the request of a licensed importer, licensed manufacturer, or licensed dealer of firearms (as such terms are defined in section 921 of title 18, United States Code), which background check determines that the receipt of a grandfathered semiautomatic assault weapon (as defined in section 921(a)(49) of title 18, United States Code) by a person would violate subsection (g) or (n) of section 922 of title 18, United States Code, the System shall notify the law enforcement agencies described in subsection (b), including in a case where such a determination is made after 14 business days have elapsed since the licensee contacted the System.

“(b) Law Enforcement Agencies Described.—The law enforcement agencies described in this subsection are the law enforcement agencies that have jurisdiction over the location from which the licensee contacted the System and the law enforcement agencies that have jurisdiction over the location of the residence of the person for which the background check was conducted, as follows:

“(1) The field office of the Federal Bureau of Investigation.

“(2) The local law enforcement agency.

“(3) The State law enforcement agency.”.

(b) Clerical Amendment.—Section 1(b) of such Act (34 U.S.C. ch. 409, front matter) is amended by inserting after the item relating to section 106 the following:


“107. Notification to law enforcement agencies of prohibited purchase or attempted purchase of a firearm.”.

SEC. 7. USE OF BYRNE GRANTS FOR BUY-BACK PROGRAMS FOR SEMIAUTOMATIC ASSAULT WEAPONS AND LARGE CAPACITY AMMUNITION FEEDING DEVICES.

Section 501(a)(1) of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3751(a)(1)) is amended by adding at the end the following:

“(H) Compensation for surrendered semiautomatic assault weapons and large capacity ammunition feeding devices, as those terms are defined in section 921 of title 18, United States Code, under buy-back programs for semiautomatic assault weapons and large capacity ammunition feeding devices.”.

SEC. 8. SEVERABILITY.

If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act, the amendments made by this Act, and the application of such provision or amendment to any person or circumstance shall not be affected thereby.

The Lee County Local Planning Agency is scheduled to hear the Bay Harbour Marina Village project developer Jack Mayher's second suggested Bay Harbour Marina Village DRMUWD Comprehensive Plan Amendment (CPA2017-00005) on Monday, March 26 at 8:30am in the County Administration East Building, 2201 Second St, Fort Myers, FL 33901, Room 118 (First Floor). Any concerned residence are suggested to attend.
 
The height of the condominium tower has been cut back 30 feet from 175 feet to 145 feet; about 15 units were changed to townhouse style housing along the canal; and the building moved 35 feet off Main Street, with a Free to the public "civic space" with tennis courts and other amenities. 
 
The townhouse housing will act as a residential buffer between Oak Street neighbors and the condominium tower.  A bike lane and some on-street parking was suggested for Main Street.
 
LPA's commissioners will be considering changing the property's land category to Destination Resort Mixed Use Water Dependent (DRMUWD). This use is already at play on the island: EbbTide was approved with this use, but it has not yet been built.
 
DRMUWD technically requires at minimum an 8-acre property. The Bay Harbour site is only 7.58, and the applicant proposes an amendment with the DRMUWD text to admit the decrease in acreage and an increase in density when the additional density is dedicated to workforce housing. Of the 113 residential units proposed, 38 are dedicated to workforce housing.
 
The Bay Harbour Marina Village project would place 113 residential units, 38 workforce units, a marina, a 500 plus space parking garage and other commercial space on a 7.58-acre piece of land, which now houses Southern Comfort Storage. It needs a comprehensive plan amendment and a rezoning approval to be built, two steps which the developer has requested are kept concurrent.
 
"It's the second time we've had a full staff recommendation," Mayher said. "I think that's pretty telling that it's the right thing for that property." Mayher also added, "The LPA and the HEX were buffaloed by people who cried wolf," he said. "The land use classification already exists on the island." 
 
The president of the Beach Area Civic Association, Charlie Whitehead, has opposed the creation of additional island density on Bay Harbour's property, stating,  "That adding more homes on a barrier island is a mistake." Whitehead said, "It's not a popularity contest, the LPA's job is to evaluate a project based on its consistency with the county's document. I think they're too smart to stack that much density in a hurricane evacuation zone."

Secret Debate Tip For GOP

On CBS's "60 Minutes" Sunday night, Lesley Stahl asked Education Secretary Betsy DeVos about the "institutional racism" in school discipline.

It was like neither of them had ever heard of Nikolas Cruz. The Parkland, Florida, school shooter is our most recent case study of what happens when liberals start babbling about "institutional racism."

There's never been such an incredible paper trail as there is with Cruz, leading straight from idiotic liberal ideas directly to mass murder. We know that Broward County Public Schools knew about Cruz's felonies. We know that his behavior wasn't reported because it would negatively impact the record of a student of color. The school district bragged about the policy.

Perhaps having no criminal record would have helped Cruz get a good job someday. But it is a fact that one of the consequences of not reporting his crimes was that HE COULD GET A GUN.

Unless liberals are going to say that guns had nothing to do with the Parkland shooting, it was the racial bean-counting in school discipline that unleashed this psychotic on innocent students and teachers at Marjory Stoneman Douglas High School four weeks ago.

Stahl treated as cold hard fact the idea that schools punish "students of color more harshly than their white classmates," citing this real-world example:
"Let's say" -- lots of serious journalism begins with "let's say" -- "there's a disruption in the classroom and a bunch of white kids are disruptive and they get punished, you know, go see the principal. But the black kids are, you know, they call in the cops. I mean, that's the issue: who and how the kids who disrupt are being punished."

I remember this plot on "Law & Order," but there aren't many examples of it in real life.

Teachers in St. Paul, Minnesota, have been hospitalized and permanently disabled by their "disruptive" African-American students, thanks to former St. Paul Public Schools Superintendent Valeria Silva's commitment to ending the "school-to-prison pipeline."

One kid was "disruptive" by punching and strangling a science teacher, John Ekblad, giving him a concussion and permanent brain injuries. The African-American student walked away from Ekblad's body splayed out on the floor, saying, "Did you see me slam that white-ass teacher?"

This "disruptive" rascal was sentenced to 90 days house arrest and probation. Luckily, he wasn't punished more severely, or he might have ended up on the "school-to-prison pipeline." I'm sure he's doing well now.

A popular grade-school teacher, Debbie York, had to undergo repeated surgeries after an 85-pound first-grade student of color assaulted her when she tried to intervene as he was throwing furniture and biting other children. He threw a chair at York, missed her, then body-slammed her, causing permanent injuries.

While on sick leave after the incident, York emailed parents to explain why she was gone. For informing parents about the assault in class, she was promptly cashiered from her 30-year teaching career.

What matters isn't the safety of teachers and students. Nor is it whether anyone is learning anything. All that matters is that no one ever writes down the bad behavior of black and brown students.

When public school teachers -- not a conservative bunch -- in Minnesota -- not a conservative state -- are showing up in a boiling rage at school board meetings to complain about their African-American students having carte blanche to bully and defy them, the problem may not be that our schools are being run by Bull Connor.

One teacher, David McGill, complained that an out-of-control African-American fourth-grader had "significantly compromised an entire year of science instruction for the great majority of his classmates." He said there was nothing he could do about it because of the school's racial quotas on student discipline.

Superintendent Silva's response was to get snippy about the teacher's word choice:
"You said they are 'infecting' other children. I almost fell out of my chair," Silva said.

"I didn't mean it --""Doesn't matter. You said it."

Eventually, the school district had to buy off Silva with a $800,000 severance agreement just to get her to leave. It was her or the teachers.

CBS's Stahl is either an ideologue, intentionally painting a picture that is the polar opposite of the truth by implying that students of color are the true victims here -- or else she is so stupid and untutored in the subject that she has no business reporting on it. I could go either way. Your choice. (We need an expression for this sort of broadcast. Something like ... FAKE NEWS!)

A smart Republican would be dying for liberals to bring up the "school-to-prison pipeline." The more it is talked about, the more ripe the insanity becomes.

Worried about suburban moms, Republicans? Make the Democrats defend a toxic ideology that prohibits students of color from being arrested for their criminal acts. They'll either defend it and lose the parents, or they'll oppose it and lose their George Soros funding.

Republicans should pray that the Parkland shooting comes up in debates. You hear "Parkland," and you say: "Let's talk about the 'school-to-prison pipeline.'" You hear, "equity in school discipline," and you say: "Nikolas Cruz."

This age group may think e-cigarettes are safe, but there's evidence that the devices contain cancer-causing ingredients.

Teenagers who use e-cigarettes are ingesting many of the same carcinogens found in regular cigarettes, according to a study published Monday in the medical journal Pediatrics. And those who use fruit-flavored e-cigs may be exposed to even more cancer-causing chemicals than those who use the tobacco-flavored ones.

“The presence of harmful ingredients in e-cigs is well established,” says Mark Rubinstein, M.D., a researcher at the University of California, San Francisco’s Tobacco Control Center, and the study’s lead author. “We can now say that those toxins are making their way into the bodies of teenagers who use these products.”

The study focused on teens because there's concern that this age group sees e-cigs as risk free. Teens may think this because e-cigarettes are often promoted as a less-toxic alternative for adults struggling to kick the "regular cigarette" habit.

“They think the vapor is just water vapor,” Rubinstein says. “And some of the advertising around these products reinforces that belief.”

More than twice as many teenagers use e-cigs as traditional cigarettes, according to a 2016 survey by the U.S. Department of Health and Human Services.

Rubinstein and his colleagues compared 103 teenagers who were divided into three distinct groups: those who smoke both e-cigs and regular cigarettes; those who smoke e-cigs only; and those who don’t smoke either. They checked the teens' saliva and urine for the presence of several toxins found in both e-cigs and regular cigarettes, including some known to cause cancer.

Toxin levels were generally highest among those who smoked both regular cigarettes and e-cigs, and lowest among those who did not smoke either product. Some chemicals were three times higher in the “dual use” group than they were in the "e-cig only" group. And there were chemicals found to be three times higher in the "e-cig only" group than they were in the non-smoking group.

Nicotine-Free E-cigs Still Have Risks

Some e-cigs contain nicotine, and some don't. Studies indicate that many teens think nicotine-free e-cigs are safe and unlikely to increase the risk of cancer. But the new study found that, among the teenagers who only smoked e-cigarettes (the "e-cig only" group), several cancer-causing compounds were just as high in users of nicotine-free e-cigs as in those who vaped with e-cigs that contained nicotine.

Previous studies have shown that e-cigs contain additives and solvents that can become carcinogenic when heated. The current study confirms that many of those chemicals are equally prevalent in both nicotine-containing and nicotine-free e-cigs.

 

Fruit Flavors May Increase E-cig Use

Overall, fruit-flavored e-cigs were the most popular type of among teenagers who participated in the study: 55% of the “e-cig only” group, and 67% of the “dual use” group, said they used fruit flavored e-cigs most often.

Those who preferred fruit flavors tended to use e-cigs more frequently, and also had significantly higher levels of one toxin in particular (a cancer-causing chemical known as acrylonitrile). It's unclear if those higher concentrations were due to the increased amount of e-cig consumption, or because of the flavoring itself. But the finding indicates that despite what many teens may think, fruit-flavored e-cigs come with their own risks, and are not necessarily safer than tobacco-flavored ones.

 

Some E-cigs May Be Worse Than Others

Previous studies have suggested that toxin exposure can vary significantly by the brand and type of e-cig product. For example, e-cigarette devices with higher voltages (or those that can be modified to increase the voltage) are riskier, because higher voltages tend to produce more toxins.

The current study was not able to measure the differences between various e-cig products, but the authors have follow-up studies planned that may address this question.

In the meantime, this much already seems clear: According to health officials, study authors, and Consumer Reports medical experts, no e-cigarettes are safe. The best way to protect against cancer and other diseases is to not smoke at all.

While locally we worry about water quality, and complain about Red Tide and brownish water, the picture globally is much worse. Coral Reefs are dying across the world! The problem: Plastic Trash!

A new study shows that billions of pieces of plastic pollution are snagged on coral reefs, sending disease rates soaring.

Scientists examined 124,000 corals from 159 reefs located across the Asia Pacific region. The study, conducted between 2011 and 2014, determined that pieces of plastic cut corals, deprive them of light and oxygen, and provide a means for pathogens to invade the organisms, and found 89% of those fouled by plastic were suffering disease. On plastic-free reefs, only 4% of the corals were diseased thus, coral reefs that are clogged with plastic are 20 times more likely to be diseased than those corals that are free from immediate plastic pollution.

The work is highly significant because it is the first to examine the impact of plastic on disease in any marine organism and also the first to produce a large-scale estimate of how much plastic pollutes the sea floor. Coral reefs in the region are contaminated with 11billion pieces of plastic, the research indicates.

Over 8 million tons of plastic are dumped in the ocean every year and it now the polution has reached even the remotest corners. Microplastics, formed when plastics are broken up, can be mistaken for food by sea creatures and early studies have shown this causes harm. Tamara Galloway, Professor of Ecotoxicology, from Plymouth University, in a separate study has highlighted the need to reduce the amount of plastic waste and therefore microplastics entering our seas.

She said: "Plastics are enormously beneficial materials. However, if marine plastic pollution continues to increase, impacts such as those demonstrated in our laboratory studies could occur in the natural environment. It is therefore important that we prevent the accumulation of plastic and microplastic debris in marine habitats through better waste-handling practices and smarter choices in the materials we use.”

The scientists who conducted the new study did not set out to research plastic but were confronted by it across the regions they surveyed. The correlation between plastic pollution and high rates of disease was very striking and the researchers believe plastic fragments cut the coral organisms, while plastic fabrics smother them and block out light and oxygen.

“Corals are animals just like me and you – they become wounded and then infected,” said Joleah Lamb, at Cornell University, who led the new research, published in the journal Science. “Plastics are ideal vessels for micro-organisms, with pits and pores, so it’s like cutting yourself with a really dirty knife.”

She said that once a coral is infected, disease usually spreads across the colony: “It’s like getting gangrene on your toe and watching it eat your body. There’s not much you can do to stop it. If a piece of plastic happens to entangle on a coral it has a pretty bad chance of survival.”

“The take-home message for individuals is to be more considered about the amount of single-use plastics you are using and think about where your plastic goes, these little things do matter.” Lamb told The Guardian.

Coral reefs are not only a wonder of the natural world, home to myriad spectacular creatures, but they are also vital for at least 275 million people who rely on them for food, coastal protection from storms and income from tourism. The scientists said it is “critical” to cut plastic pollution.

Prof Terry Hughes, at James Cook University in Australia and not part of the study team, said: “I’d never thought of bits of plastic as a vector of disease spread from the slime that coats them, but the study shows convincingly that corals entangled in plastic are 20 times more likely to be infected.”

Prof Alasdair Edwards, at Newcastle University, UK, and also not involved in the new study, said the combined impact of plastic-related disease and climate change could be very serious: “Warming oceans are still the major threat to corals, but this paper shows that in areas more affected by humans, as exemplified by plastic debris, the chance of corals recovering from mass-bleaching and mortality events may be severely compromised. Corals need all the help they can get.”

Lamb said the one hopeful aspect of the plastic pollution problem was that people can take direct action: “The take-home message for individuals is to be more considered about the amount of single-use plastics you are using and think about where your plastic goes. These little things do matter.”

The researchers also estimated that the plastic pollution tarnishing coral reefs in Asia-Pacific will soar by 40% by 2025 to 16bn pieces, unless action is taken. The true number is likely to be higher, as China and Singapore were not included in the analysis.

 

 

This weekend everyone is focused on St. Patrick's Day, it falling on a Saturday makes for even more of a festive mood. Parties, both public and private are plentiful across the county.

On Saturday March 24th, the second annual Fort Myers Beach Spring Break Wave Challenge will be held starting at noon, this year the event will be hosted by the Lani Kai and once again organized by Fear No Fin Apparel with arial video photography by LightMark Productions.

The event encourages everyone to come to the beach and come together along the shoreline and do an enormous wave to bring awareness for the importance of clean water and water conservation. Waves are very popular at sporting events and will travel around a stadium many times as organizers felt it would be an easy thing to do on the beach allowing all interested parties to show their support for keeping our coastal waters clean.

Those participating should arrive at the Lani Kai from noon to 1pm, where they can enjoy double DJs and a wealth of raffle prizes. Any donation to "Keep Lee County Beautiful" gets you entered to win a "two nights stay" at the Lani Kai.

Everyone will form a line along the shoreline behind the hotel, and continue on either side until everyone has a spot. The Wave will then start from one side to the other for about 15 minutes, with drones operated by LightMark Productions capturing the aerial action.

At 1:15 everyone will start lining up to do the wave. At promptly 1:30 Lightmark productions will start filming the wave. Immediatly after the "wave" the drawing will be held at the beach stage. You must be present to win.

I repeat, this event is to bring awareness to Water Quality and Water Conservation, over the past few months, the rain has been scant and water levels of Lake Okeechobee have remained low, so there have not been any water releases. While walking the shore these days, the water looks great.

The water quality on our beaches and surrounding bays comes under scrutiny again as we approach our rainy season. Heavy rains raise the water lever in the lake and then the Army Core of Engineers release water into the Caloosahatchee River which brings brown water to our beaches and shores sometimes causing Red Tide.

If you’re wondering what the challenge is, the promoters are putting out a challenge to other spring break destinations “Daytona, Fort Lauderdale, Gulf Shores, South Padre, South Beach, Panama City etc” to have Fear No Fin come to their beach to promote “The Wave” and see if they can do a longer wave than FMBeach, bringing more awareness to this issue. Any money raised will go towards water quality and conservation at their local beaches.

Last year the event was a great success with hundreds of participants and a wave that was over a quarter mile long. This year the hope is to double that or more! Come on out and bring a friend to support this worthy cause.

Former President Obama lived a life of lies and deceit before becoming President and expanded his deceitful ways into very serious crimes, during his 8 years of his “mission’, in my opinion.

Obama “sealed”, classified, and other wise, hid Fast and Furious papers form purview, like he did his passport, his college FAF forms, his Social Security Numbers, and many other records, including those overflowing into the deceit used in the FISA courts!

I am certain there is no other reason for Obama to either Classify or use Executive Privilege to hide the facts from the Congress Intelligence Committee and the family of our Border Patrol Agent Brian Terry, other than to protect Eric Holder and/or himself from possible criminal charges for blatant criminal negligence or some other crimes.

The use by Obama of our FISA court for, what I believe was his “personal Black Ops” agency, to monitor his political foes, news reporters, those who were critical of him, and other personal reasons, seems to be overwhelming. Who else would…who else could have ordered Susanne Powers to unmask the identity of over 300 US citizens in Obama’s last year, 2016? Clapper, Brennan and Rice all say, under oath, that they know nothing about it. So who ordered the unmasking? Unmasking is not a minor deal, it is a major deal! The names of citizens discovered during a FISA over hear of foreigners, according to FISA Law, are to be deleted. Who ordered the unmasking and why? Congress and we the people, demand an answer!

Only the President can review the FISA court evidence and make the determination, if a crime probably was committed, who should investigate and then order the investigation. Only the President can declassify Documents that Agencies refuse to declassify! The President of the United States doesn’t “ask” the Attorney General or FBI Director to open or close an investigation; he tells them to do so! He may ask their opinion and then direct them to act…but the President “is” the boss…he doesn’t ask…he directs. That is what President Trump, in my opinion, must start doing or, in the very least, he should start reviewing evidence and see what the hell is going on! Declassify the records DOJ is withholding from Congress. It is Obama holdovers who are refusing to release…I’ll bet any money on that!

He should, in the very least, examine all the FISA papers regarding the Carter Page case and then if warranted, declassify all those documents, so Congress can do their job. If the President doesn’t want to take charge, for whatever reason, then allow Congress and “we the people” know if Obama abused the FISA court system and the Rights of Citizens, against illegal Search and Seizure!

“So over the last several days Mr. Speaker there has been a lot of discussion about an open and honest debate with respect to school shootings, gun violence, gun control etc.

And an open and honest debate as I understant it, is one that would rely on data, facts, evidenc, analysis, reason, logic etc.etc.

And I'm certainly willing to have that debate, I think if we were going to look seriously at school shootings and gun control we would analyze things like.... why do all mass shootings seem to take place in gun-free zones?

Wouldn't it be reasonable to test whether or not the efficacy of gun-free zones have actually achieved what their intended intent is.

We'd start to look at... most of these shooters come from broken homes, what sort of government policies have actually encouraged broken homes, you can look at left-leaning think tanks like the Brooking Institute, who will actually say that some of it can be attributed to various cultural changes that happened in the sixties to include the abortion industry.

You could look at more conservative-leaning organizations that will say the welfare states contributes significantly to dismantling the family as families became more and more dependent on the government, then they were.... mothers and fathers in the home raising children.

We could look at various status with those areas in the United States and around the world that have strict gun-control measures and what their crime rates look like, weather at Chicago, New York City, Washington DC and others, that have incredibly strict gun laws and yet for some reason hasn't seemed to stop the gun violence in those particular areas.

We can look at the analysis of 538, which is considered more of a left of center data analysis Think Tank, we have several analyst now confirm that data they were looking at not just in United States but in Canada, Great Britain and Australia, that they were shocked that the data did not support what they thought gun control measures would actually achieve. We can look at the number of cases within the United States where a gun has been used for self-defense, estimates range everywhere from one hundred thousand uses too close to a million uses within the United States. Now, some organizations and some reporters only report on the ones where a gun was used and it actually resulted in the death or maiming of the perpetrator, but if you look at the ones where the gun was used where the mere presence of the firearm actually dissuaded the criminal from committing an act of violence, an act of rape, an act of murder, the number shoots up, it skyrockets.

So when people on this side talk about the importance of the Second Amendment please understand it's not just some base philosophical conviction we all have, it is rooted in the idea, that while we may be a post-enlightenment society, the vast majority of horrible atrocities that we've seen have happened in those post enlightenment societies, it's happened as a result of government systematically disarming citizens and claiming themselves to be the sole responsible party for their security, and then turning on those same citizens and punishing them.

That's the most egregious cases but in the individual cases of self-defense, that's why people on this side of the aisle hold the 2nd Amendment in such high esteem because we honestly believe that you have an inherent right to defend yourself, and your ability to defend yourself should not be excluded to your size. Firearms provide someone that is weaker and not as fast, the ability to actually defend themselves from a stronger attacker.

Some of the other things that we would look at and some of the things that I would hope we would have bipartisan support for... all of us agree that we need to make sure that our students are better protected when they go to school.
One of the things that we would look at is arming certain teachers, not every teacher but a teacher that is comfortable with it, is former law enforcement, is former military, that is now in the classroom, Deligate Plum said yesterday that that was ridiculous to consider... why? Is it because the other side of this debate will only accept one "solution" to this problem and that is tearing apart or gutting the Second Amendment.

And I understand we're going to mention just a couple of the bills that were done this year ... background checks getting rid of bump stocks.

If you’re wondering the other reason that we can't have an honest debate over this one, is quite frankly because I don't think any of us on this side of the aisle believe you when you say "that's all you want to do"

It will be bump stocks and be background checks then we'll be different kind of background checks at register the guns, then after that it'll be we need to ban assault weapons ... what's an assault weapon? Something that looks scary.

Then after that it'll be semi-automatic rifles, after that it'll be semi-automatic handguns, then it will be revolvers, shotguns...Because when the policies fail to produce the results you are promising to your constituents, you'll be back with more reasons why we have to infringe on Second Amendment rights.

The other reason why it's really difficult to have an honest and open debate about this, it's because of members of this body comparing members on this side of the aisle to Nazis.

Members on the other side of the aisle saying that when a 24 year old teacher gets up and says that the whole debate is between the Second Amendment or her life. That's a false dilemma. And quite frankly one of the ones that I've found most offensive, along with being compared to Nazis, was being compared to segregationists.

I just want to remind everyone of something very quickly, it was not our party that supported slavery, that fought women's suffrage, that rounded up tens of thousands of asian-americans and put them in concentration camps, that supported Jim Crow, that supported segregation, or supported Mass resistance... That wasn't our party... That was the Democrat Party!

Now I'm thrilled at the Democrats no longer believe that and I don't believe that a single current member of this body who is the Democrat, ever believe those things but I would really appreciate it if every time you want to make a powerful point you don't project the sins, the atrocities, and the injustices, the Democratic Party perpetrated on others ...onto us

So if we want to have an open and honest debate, I'm all for that, let's do that, but let's start with a certain degree of mutual respect. It starts with a certain degree of not assuming that the only reason why we believe in the 2nd Amendment is because the NRA paid us off? Well if that's the sort of logic you want to use, why don't you go take a look at how much money the NRA spends and how much money Planned Parenthood spends, because when I get up here and talk about abortion I don't assume that you're a bought and paid for by Planned Parenthood. I don't assume you're horrible people, because I disagree with you on a policy position. I assume that you have deep convictions that we can have argument and debate about it.

But if you're not willing to reciprocate that level of respect, well don't be surprised when it becomes more difficult to talk about these things. Because there is a lot that we can do and there is a lot that we need to do to ensure the security of our children, and our citizens.

But yes we are going to have a problem with so-called “Solutions” which infringe on people's liberty under the promise... the government will provide for the security, because ultimately in this last shooting we had the perfect example of government being engaged over 30 times and still failing to provide security for those students.

By the Numbers

There are 30,000 gun related deaths per year by firearms, and this number is not disputed. U.S. population 324,059,091 as of Wednesday, June 22, 2016. Do the math: 0.000000925% of the population dies from gun related actions each year. Statistically speaking, this is insignificant! What is never told, however, is a breakdown of those 30,000 deaths, to put them in perspective as compared to other causes of death:

• 65% of those deaths are by suicide which would never be prevented by gun laws

• 15% are by law enforcement in the line of duty and justified

• 17% are through criminal activity, gang and drug related or mentally ill persons – gun violence (also justified self defense falls in this category)

• 3% are negligent discharge deaths

So technically, "gun violence" is not 30,000 annually, but drops to 5,100. Still too many? Well, first, how are those deaths spanned across the nation?
• 480 homicides (9.4%) were in Chicago
• 344 homicides (6.7%) were in Baltimore
• 333 homicides (6.7%) were in Detroit
• 290 homicides (5.8.%) were in NY City
• 119 homicides (2.3%) were in Washington D.C. (a 54% increase over prior years)

So basically, 31% of all gun crime happens in just 5 cities. All 5 of those cities have strict gun laws, so it is not the lack of law that is the root cause.
But what about other deaths each year?

• 40,000+ die from a drug overdose–THERE IS NO EXCUSE FOR THAT!

• 36,000 people die per year from the flu, far exceeding the criminal gun deaths

• 34,000 people die per year in traffic fatalities(exceeding gun deaths even if you include suicide)

 

Now it gets good:

• 200,000+ people die each year (and growing) from preventable medical errors. You are safer in Chicago than when you are in a hospital!

• 710,000 people die per year from heart disease. It’s time to stop the double cheeseburgers!

So what is the point?

If the anti-gun movement focused their attention on heart disease, even a 10% decrease in cardiac deaths would save twice the number of lives annually of all gun-related deaths (including suicide, law enforcement, etc.). A 10% reduction in medical errors would be 66% of the total gun deaths or 4 times the number of criminal homicides......Simple, easily preventable 10% reductions!

So you have to ask yourself, in the grand scheme of things, why the focus on guns? It's pretty simple.:
Taking away guns gives control to governments.

The founders of this nation knew that regardless of the form of government, those in power may become corrupt and seek to rule as the British did by trying to disarm the populace of the colonies. It is not difficult to understand that a disarmed populace is a controlled populace.

Thus, the second amendment was proudly and boldly included in the U.S. Constitution. It must be preserved at all costs.
