How Migrant Surge at the Border Fuels Massive American OD’s From Fentanyl Florida Gov. Ron DeSantis says he will ask state lawmakers to cut gas and fuel taxes by $1 billion when the legislature convenes in January. His challenger, U.S. Rep. Charlie Crist and former governor, asked him to lower gas and fuel prices before the holidays. “With the holiday season approaching, it’s time the governor turned his attention to the real issues facing Floridians,” Crist said in a news release. “Instead of convening a special legislative session in Tallahassee that hurts our residents and businesses, the Governor and the Legislature should suspend the state gas tax for the rest of the year so that we can finally offer relief to hardworking Floridians and mom-andpop small businesses being squeezed at the pump." DeSantis argues gas prices are higher because of Biden’s energy policies that Crist supports. In addition to the tax cut, DeSantis called on fuel stations to cut prices by 25 cents a gallon. DeSantis said he’s concerned that an increase in salaries and wages won’t be enough to cover the rising costs of goods due to record inflation. DeSanits blames inflation on Biden’s economic policies. “Even if you start making more money, if the prices [for goods and fuel] are going up faster than your wages or salary, you’re actually losing money in this inflationary economy,” he said. The national average price for a gallon of regular gasoline is $3.41. For diesel, it's $3.64 a gallon, according to AAA. Gas prices were up $1.29 a gallon on average nationwide compared to the same time last year, according to the U.S. Energy Information Administration. It’s manufactured mostly by Mexican cartels with ingredients imported from China, and then smuggled over the southwestern U.S. border. Fentanyl has been arriving in larger quantities each year since at least 2016. The cartels are taking advantage of law enforcement weaknesses and policy failures to smuggle record amounts of the lethal drug into the United States, according to interviews with half a dozen current and former drug and immigration agents. While a lack of screening technology to find contraband at ports of entry and an inept U.S-Mexico campaign to cripple the cartels are longstanding issues, there’s also a new one: the flood of migrants across the border that the Biden administration has done little to stop. Former law enforcement officials say the cartels are behind the surge, overwhelming the capacity of agents to pursue drug smugglers. They can freely enter Texas, New Mexico, Arizona, and California carrying fentanyl while agents are diverted to apprehending and processing migrants. Frustrated border agents and their union have been calling on Congress to send reinforcements. But help is not on the way. The administration’s upcoming budget request doesn’t include funding for more Customs and Border Protection agents. Instead, the administration is embracing a public health approach to the fentanyl crisis. It has proposed spending $11.2 billion – a huge increase over last year – to expand substance abuse prevention, treatment, and recovery services. But curbing opioid addiction is very challenging. Most substance abusers avoid treatment, according to researchers, and only about one-third of those receiving long-term medical care fully recover. That means there are more opportunities to flood the Internet with videos, memes and movie clips showing holiday decorating mishaps, like people falling off ladders, tripping on gifts and tumbling into Christmas tree. Although it’s easy to get into the holiday spirit while decorating, it’s also easy to get injured. In fact, the U.S. Consumer Product Safety Commission (CPSC) notes there are about 200 decorating-related injuries each day during the holiday season. Thousands of people seek treatment at the emergency room each year after decorating mishaps. Half of all decorating-related injuries are falls, according to the CPSC. People fall from ladders while stringing lights, stretching to perfectly place ornaments onto the tree and retrieving heavy boxes of decorations from storage. Seniors already face a high risk for falling – one in four seniors suffer a fall each year, according to the Centers for Disease Control and Prevention. Holiday decorations pose additional safety concerns as homes transform into winter wonderlands at year’s end. To minimize fall risks for yourself, and seniors, this holiday season, consider these eight decorating tips: • Exterior lights: Stringing lights onto the roofline or around trees can be dangerous. Instead, utilize inflatables, net lights on shrubs or laser projectors to light up your home’s exterior. • Ladder safety tips: Ladders are meant for reaching vertically, not horizontally. Stretching to hang ornaments or lights is how you can get hurt. If you need to use a ladder, always face the ladder when ascending and descending, ensuring you have at least one hand to grasp the ladder. Never use the top of the ladder as a step and be sure to use a ladder with a wide base at the bottom for support. If the object you want to reach is too heavy or too far, ask a friend to help. • Extension cords and light strands: The Christmas tree, music boxes and other holiday decorations requiring electricity should be placed near outlets. Cords create trip hazards and are especially dangerous for curious children and pets. • Gifts: It’s a blessing to have a bounty of gifts beneath the Christmas tree, but presents and gift bags can pose trip hazards. The Sun Bay Paper Page 6 What once were comprehensive explanations about a topic, “narratives” have evolved into “points of view” and too often, outright political “spin.” Politicians’ emphatic but incomplete narratives lead to uninformed voters, harmful legislation, and impetuous presidential actions. Following are three active “narratives” that give me concern. The Kyle Rittenhouse trial in Kenosha Wisconsin was surrounded by narratives, mostly incomplete. For those disappointed with the trial’s outcome, reactions were variations of the following: “Our broken legal system permits bringing weapons into situations such as the Kenosha riots. That and ‘self-defense’ laws give white supremacists permission to commit murder.” While stammering through explanations of what happened, their narrative ignores the atmosphere that existed in America during the summer of 2020. There were legitimate demonstrations to be sure, but in many cities rioting, looting and many kinds of destruction were out of control for up to several months. Kenosha was one of those experiencing serious rioting and arson. Many politicians seemed afraid to take a stand against lawlessness which was poorly disguised as social justice activities. Thugs often controlled the streets while much violence went unchallenged. In city after city, businesses and citizens knew their only alternative was to rely on themselves, their friends, and those they could recruit to protect their property. Legal firearms were part of the solution to the absence of proactive law enforcement. Protection of property is what Rittenhouse was asked to participate in and what he thought he was getting into that night. The activity in Kenosha that week was real and desperate for the business owners, and Rittenhouse’s intentions were honorable. He was naively drawn into a dangerous situation in which he was pursued and attacked. Rittenhouse killed two white rioters among the several who violently attacked him. The actual sequence of events is missing from most narratives. They don’t tell us that no real evidence of murder was presented by the prosecution. Nor would we learn that the extensive film record provided clear evidence of self-defense. Those realities comprise the “missing narrative.” This case represents the victory of rule-of-law over lawlessness. Without that complete narrative, one could conclude that the destruction and violence in Kenosha somehow represented evidence of virtue. We’ve learned that proactive law enforcement and the judicial process must once again become inseparable partners. The next incomplete narrative should have been quieted long ago. I’m referring to claims of Trump/Russia election collusion, and the debunked “Steele Dossier.” As recent as last week I read politicians’ comments about the illegitimacy of Trump’s presidency largely due to the election collusion narrative built from that infamous dossier. The Durham investigation has established that the Steele Dossier and collusion charges were without basis. Some officials and supporters of the Hillary Clinton campaign, which sponsored the fraudulent dossier, continue the incomplete account of events as if the Durham investigation hadn’t occurred. This missing narrative has led to political fraud at its worst. Consider the impact of the scam on two foolish and unsuccessful impeachment trials. Whatever flaws possessed by Donald Trump don’t justify such deceit. Perhaps public admission of their errors will occur as it has to a limited extent on CNN and in the Washington Post – about 5 years too late. Green legislation has been in the forefront ever since the democrats took control of the U.S. House of Representatives and the “Green New Deal” was introduced. And the proposed “Build Back Better” legislation will eventually allocate trillions to “green-friendly” programs and eliminate fossil fuels altogether. The narrative includes promises of cheaper energy and a windfall of green technology jobs. President Biden cancelled pipeline development and reduced availability of drilling contracts on public lands. This story can’t be accurately told without disclosing that our national energy independence, so precious to our economy and national security, has disappeared as a result. The public must be reminded that dramatic energy cost inflation was also caused by those actions. And we must shine a light on the President going, virtually “hat-inhand,” to OPEC and asking them to increase oil production to help us out during this crisis. Dear Doctor: My wife had a bad cold, and then I unfortunately caught it. Then, just as I was recovering, she got it again. What's going on? I didn't think it was possible to get the same cold twice. Dear Reader: It's tempting, and even logical, to think that your wife's cold has ricocheted between the two of you. However, viruses are abundant and opportunistic, so who was infected with which bug, and at what point in time, is up for grabs. It's entirely possible that you became infected with the same virus that caused your wife's cold. But it's equally likely that you brought home another virus of your own. If so, then on her next go-round, she may have actually caught your cold. If she did indeed pass along her virus to you, then the second cold she caught was most likely a new and different virus. That's because, thanks to the marvels of our immune systems, it's extremely unlikely to catch the same cold twice. Even if you do manage to become re-infected, thanks to the antibodies provided by your immune system, the new cold takes a significantly milder form. However, cold and flu viruses mutate readily. When that occurs, despite having developed antibodies to fight off the original cold, the altered virus can indeed make you sick again. Whether your family's illnesses were the result of one, two or even three different viruses, there are simple and effective steps you can take to limit their spread. These precautions are worth implementing at home, at work and while out in public. Viruses can survive for up to three days on surfaces and inanimate objects. When caring for someone who is ill, don't share food, drink, dishes, glasses or cutlery. Wash everything used by the cold sufferer in hot, soapy water as soon as possible. Be aware that the books, pens, remote controls, telephones, electronic gadgets and doorknobs that the sick person touches can harbor the virus. A spritz with a bleach solution or a disinfectant cleaner is a good idea. Making sure the sick person frequently washes or disinfects their hands is important. Ditto for the caregivers and all others in the house. Do what you can to build up your own immune system. Eat well, drink plenty of fluids, take part in regular exercise and get enough sleep. Avoid rubbing your eyes, touching your nose or putting your hands to your mouth after touching public spaces where viruses may linger. And don't forget your annual flu shot. If you do get sick, please don't try to power through. If your employer offers sick leave, take it. Your co-workers will be grateful. If you have no choice but to go to work, don't try to be a hero. Take advantage of the many over-the-counter remedies that can lower fever and reduce the symptoms that make colds so miserable. And follow good cold hygiene by taking every precaution possible: Sneeze and cough into a tissue, wash your hands often, and don't share food, phones or any objects that may harbor germs, so as not to spread the virus. Just because you die in Florida, that does not mean all of your assets are governed by Florida law. If you own shares of a corporation or partnership, for example, your estate's rights may be governed by the laws of another state. Furthermore, your estate may be restricted in terms of how it may dispose of such business interests. Florida Court Declines to Hear Claim Against Out-of-State Family Partnership Many businesses use buysell agreements as a tool to ensure continuity of ownership. Basically, a buy-sell agreement states that when a partner or owner dies, a specified person or group–often the other partners or co-owners–has the legal option to purchase the deceased party's interest. The agreement should also specify a method for properly valuing the deceased party's share. Buy-sell agreements are generally enforceable and they can override other provisions of an estate plan or Florida probate law regarding inheritance. This is why it is important to consult with a Florida probate attorney if you are uncertain as to the potential impact of a buysell agreement on your own business interests. In some cases, an agreement can even prevent your estate from litigating a dispute in the Florida courts. Here is a recent example. This case involves the disputed fractional ownership of a farm in Massachusetts. The decedent in this case belonged to a family limited partnership, of which she held a 0.2 percent interest. The partnership agreement, signed six years before the decedent's death, contained a buy-sell provision. Specifically, when a limited partner died, the agreement said the partnership had the right to buy back the deceased partner's share unless she left it to a family member. In this context, family member did not include spouses. This became an issue when the decedent's husband attempted to claim the shares in the family partnership for himself. The husband opened a probate estate for his wife in Florida. More than three years after her death, he moved to reopen the estate and asked a Florida court to hold that he lawfully owned the shares, as the partnership had not exercised its option under the buy-sell agreement within the specified time period. The partnership maintained the Florida courts lacked “personal jurisdiction” to hear the case. In any lawsuit a court must have jurisdiction over both the subject matter of the dispute and the parties themselves. Here, the partnership is based in Massachusetts. Furthermore, the partnership agreement itself–including the buy-sell provision–is governed under Massachusetts law. Given this, a Florida appeals court held the husband could not pursue his claims in Florida unless he could demonstrate some sort of “minimal contacts” between this state and the partnership to justify invoking personal jurisdiction. That is more than twice the number arrested in October last year, and it is an all-time high for the month of October. But President Joe Biden's Homeland Security Secretary Alejandro Mayorkas thinks that's A-OK. Asked to give himself a grade for his job on securing the southern border, Mayorkas told the Senate Judiciary Committee this Tuesday, "I am a tough grader on myself, and I give myself an A." Almost 1.7 million illegal immigrants have been arrested (or, more often, turned themselves in to apply for asylum) crossing the southern border since Biden became president, a 300% increase from the January through October numbers for former President Donald Trump's last year in office. Hundreds of thousands of these illegal migrants have been released into the United States, tens of thousands of them without even a notice to appear in court. As deaths from illegally imported fentanyl and other opioids continue rising in Colorado and other states, one cannot argue this is a problem only for border states. It means Colorado Sens. Michael Bennet and John Hickenlooper and Gov. Jared Polis need to get serious about understanding border problems and demanding a federal solution. Even illegal immigrants with court dates know it will take years for their meritless asylum claims to be rejected (and more than 85% of such claims are rejected), so the Biden administration is effectively giving these migrants ample time to disappear in the knowledge that Biden will make no effort to deport them. Voters have not only noticed the dramatic increase in illegal immigration since Biden became president, but they also blame Biden for the crisis, and they want it dealt with immediately. According to the latest Harvard-Harris poll, 68% of voters believe the crisis at the southern border needs to be addressed immediately. And 65% of voters specifically blame Biden's executive orders for increasing illegal immigration. Fifty-four percent say that Biden's policies are "creating an open border." Unfortunately, voters will not get their wish. An overwhelming 71% of them believe migrants crossing the border illegally should be immediately returned to Mexico instead of being released into the U.S. But Mayorkas released a memo just last month instructing Customs and Border Protection to do the exact opposite -- to keep catching and releasing illegal migrants into the U.S. as quickly as possible. Asked by Senate Judiciary Republicans Tuesday how many COVID-positive illegal immigrants he had released into the U.S., Mayorkas said he didn't know. Asked how many convicted criminals he had released into the U.S., Mayorkas said he didn't know. Asked how many migrants had died trying to cross the southern border illegally, Mayorkas said he didn't know. The Biden administration's immigration policies are harming people and adding to the humanitarian crisis at the border, and nobody charged with managing the situation seems to know any relevant facts. Border security is a tough issue. It is hard to look at a parent who has traveled thousands of miles to try and find a better life and tell them that they cannot enter the U.S. But just because a country is poor doesn't mean the citizens of that country have a valid asylum claim. Asylum is for people persecuted by their governments, not for economic migrants. There are literally billions of people in poor countries who want to come to the U.S. for a better life. Mass migration to the U.S. by all of them is not a viable strategy for eradicating world poverty. It would also cause a humanitarian disaster. That is why the U.S. has laws that require turning people away at the border instead of just releasing them into the country. Over 70% of the country gets this. If Biden and Mayorkas don't figure it out soon, voters will remove them and many other Democrats from positions where they can make bad immigration policy. We know through banding programs that shorebird life spans often exceed ten years, yet since the 1970s, North American shorebird populations declined by 50 percent or more.” Penny explained that Fort Myers Beach is a great spot to see shorebirds “because it is a barrier island with seven miles of shoreline with nearby Lovers Key State Park, Sanibel and the Estero Bay, each providing necessary habitats and food sources. With so many people enjoying the beach, it is essential we give the birds space and do not disturb them. Some shorebirds migrated here from the Article that is roughly 4,000 miles from Florida so it is crucial for their survival to rest and feed without human incursion.” Shorebird Do’s & Don’ts “The most important is ‘Observe; Don’t Disturb,’” advised Penny! “Keep a distance of at least ten feet from shorebird groups when they forage along the water’s edge. Walk your dogs away from the shoreline at all times, even on a leash, because shorebirds see dogs as predators and will be ready to take flight. It is unlawful to feed Florida wildlife including shorebirds because it can make them sick and alter their natural behaviors. Food like potato chips and popcorn do not have the necessary nutrients that come from a diet of marine worms, mollusks, small fish and insects.” Penny added that “while some may think it is fun or harmless to flush shorebirds, someone else probably did it just prior and another may do it again a few minutes later, so people are flushing shorebirds all day and that is very stressful tor them. In one study, shorebirds weighed before and after a busy beachgoer weekend determined that shorebirds lost ten percent of their body weight. After their long migration, shorebirds use up their fat reserves, so it is essential they feed undisturbed to recover.” When shorebirds flush, Penny cautioned, “you are truly scaring them; they are not just flying from you because it is fun but because they are frightened of you, as we are literally giants to them! It should be simple to walk ten or more feet away from shorebirds rather than wading through them. You would not walk over someone lying on a beach blanket or kids building a sand castle, so why wander through a flock of shorebirds; treat them with that same respect. If we ‘Observe; Don’t Disturb’ the shorebirds, that would help them survive and thrive on Florida beaches.” To observe, draw or photograph shorebirds, Penny recommended to “sit or stand quietly at least ten feet away and wait for them to pass by. Cell phone cameras can take great photos from that distance. Observing shorebirds without disturbing them will reveal unique behaviors, beautiful feather patterns, and interesting feeding strategies, and before you know it, the world of birding becomes a lifetime pursuit. There are over 10,000 bird species worldwide, with 217 shorebird species of which 50 are in North America, so we are lucky to have so many shorebirds to see on Fort Myers Beach. Bird watching is a fun and interesting hobby that simply requires a pair of binoculars and you can do it in almost any habitat like a beach, lake or forest.” Penny encourages parents and grandparents to bring their children and grandchildren to the “Family Shorebird Program”: “First, it will be fun as well as educational! In summary, under the bill, Florida private-sector workers could avoid vaccination requirements if they provide medical reasons, religious reasons, or can demonstrate “COVID-19 immunity.” They could also be exempt if they agree to regular COVID-19 testing or agree to wear personal protective equipment. Employers could face fines up to $50,000 per violation if they don’t correctly follow the law. The Legislation also will bar government agencies from requiring workers to be vaccinated. In addition, it reinforces a law known as the “Parents Bill of Rights” to ban student masks and vaccination requirements in public schools. The school part of the bill came later due to months of legal battling between the state and some school districts that required students to wear masks. Those districts have dropped mask requirements recently as COVID-19 cases have subsided, and districts have not imposed vaccination mandates. Florida, and other red states, have filed federalcourt challenges to an Occupational Safety and Health Administration rule aimed at requiring tens of millions of workers to be vaccinated against COVID-19 or be regularly tested and wear masks. The rule has been put on hold after an order by the 5th U.S. Circuit Court of Appeals, which hears cases from Mississippi, Louisiana, and Texas.
